Terms and Conditions

Welcome to Nanny’s Candles, LLC (“Company,” “we,” “us,” or “our”). These Terms and Conditions (“Terms”) govern your use of our online-only website, www.nannyscandles.com (the “Site”), and the purchase of our handmade candles, wholesale products, and subscription services. By accessing or using our Site, you agree to be bound by these Terms.

If you do not agree, please do not use our Site.

2. Online-Only Business Notice

Nanny’s Candles, LLC operates exclusively online. We do not maintain a physical retail location, showroom, or offer in-person pickup. All orders must be placed through our Site and shipped to a valid address.

3. Eligibility

By using this Site, you represent that you:

  • Are at least 18 years of age, or

  • Have permission from a parent or legal guardian

You agree to comply with all applicable federal, state, and local laws, including those of the State of Florida.

4. Products and Product Variations

Our candles are hand-poured and handmade. Natural variations in color, fragrance strength, wax texture, frosting, or finish may occur. These variations are normal and are not considered defects.

Product images are provided for reference only and may not perfectly represent the final product.

5. Candle Safety Disclaimer

Our candles are intended for personal and decorative use only. By purchasing from us, you acknowledge and agree to follow all safety instructions provided on product labels and packaging, including but not limited to:

  • Never leaving a burning candle unattended

  • Keeping candles away from children, pets, and flammable materials

  • Burning candles only on stable, heat-resistant surfaces

Nanny’s Candles, LLC is not responsible for damage, injury, or loss caused by misuse, improper handling, or failure to follow safety instructions.

6. FDA, Fragrance, and Wax Disclosures

FDA Disclaimer

Candles and home fragrance products are not regulated by the U.S. Food and Drug Administration (FDA) for consumer use, and our products are not intended to diagnose, treat, cure, or prevent any disease.

Any scent descriptions, aromatherapy references, or fragrance names provided on our Site are for descriptive purposes only and do not constitute medical or therapeutic claims.

Fragrance Disclosure

Our candles may contain fragrance oils and/or essential oils, some of which are synthetic or naturally derived. All fragrance materials are used in accordance with IFRA (International Fragrance Association) safety standards.

Individuals with sensitivities, allergies, asthma, or fragrance sensitivities should review ingredient information carefully and discontinue use if irritation occurs.

Wax Disclosure

Our candles may be made with various wax types, including but not limited to:

  • Soy wax

  • Coconut wax

  • Beeswax

  • Paraffin wax

  • Wax blends

  • Gel Wax

  • Joy Wax

Wax composition may vary by product. Natural waxes may exhibit characteristics such as frosting, wet spots, or color variation, which do not affect performance or safety.

7. Orders, Pricing, and Payment

  • All prices are listed in U.S. dollars

  • Prices and availability are subject to change without notice

  • We reserve the right to cancel or refuse any order at our discretion

Payments are processed by third-party payment providers. We do not store full payment details.

8. Shipping and Delivery

We ship within the United States unless otherwise stated.

Shipping times are estimates only and not guaranteed. Risk of loss passes to you upon delivery of the order to the shipping carrier.

9. Returns, Refunds, and Exchanges

Due to the handmade and personal nature of our products, all sales are final.

If an item arrives damaged or defective, direct all inquiries and claims to your mail carrier.

10. Wholesale Terms

Wholesale purchases are subject to additional conditions:

  • Wholesale accounts require prior approval

  • Minimum order quantities may apply

  • Wholesale pricing is confidential

  • Wholesale orders are final sale

  • Unauthorized resale on third-party marketplaces is prohibited without written consent

We reserve the right to suspend or terminate wholesale accounts at any time.

11. Subscription Candle Terms

By enrolling in a candle subscription, you agree that:

  • Subscriptions renew automatically at the selected interval

  • Your payment method will be charged on a recurring basis

  • Candle scents, styles, or vessels may vary per shipment

Cancellations & Changes

Subscriptions may be modified or canceled through your account or by contacting us at contact@nannyscandles.com at least 15 days before the next billing date. No refunds will be issued for processed subscription orders.

12. Intellectual Property

All content on this Site—including text, images, logos, labels, designs, and product names—is the exclusive property of Nanny’s Candles, LLC and protected by U.S. intellectual property laws.

13. Prohibited Uses

You agree not to:

  • Use the Site for illegal or unauthorized purposes

  • Attempt to interfere with the Site’s functionality or security

  • Copy or exploit Site content for commercial purposes without permission

14. California Proposition 65 Warning

If you are a California resident or if your order is shipped to California, the following notice applies:

By purchasing our products and having them shipped to California, you acknowledge that you have received this warning and accept responsibility for proper use of our products in accordance with all provided safety instructions.

15. Disclaimer of Warranties

Our Site and products are provided “as is” and “as available,” without warranties of any kind, express or implied.

16. Limitation of Liability

To the fullest extent permitted by Florida law, Nanny’s Candles, LLC shall not be liable for any indirect, incidental, or consequential damages, including personal injury or property damage, arising from the use or misuse of our products or Site.

17. Indemnification

You agree to indemnify and hold harmless Nanny’s Candles, LLC, its members, employees, and affiliates from any claims arising from your violation of these Terms or misuse of our products.

18. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules. Any disputes shall be resolved exclusively in Florida courts.
